摘要
城市轨道交通建设与周边商业开发项目在建设过程中会产生一系列的矛盾。其中比较突出的矛盾之一就是双方建设期间对周边环境保护责任的界定问题。尤其是双方若同步建设施工,势必对周边需保护的对象产生叠加变形影响,不利于建设期间周边环境安全,且索赔责任很难直接确定。监理作为建设单位委托第三方,参与了工程建设全过程,应做好建设单位的助手,协助建设单位处理索赔纠纷。通过工程实践中遇到的实际案例,从监理方的角度来分析整个索赔事件,给类似工程以借鉴。
The development of urban mass transit not only meets people＇s demand, but also brings about business along the line, thus come out a great deal of business projects. Following the prosperity of business process, there are many conflicts between the construction of rail transit and the business around. The most important issue is the responsibility of protecting envionment, because the construction of rail transit and of business project at the same time may have a double effects on the environment, which makes the claim more difficult. Being the third party,supervision that joins in the construction shall assist the project owner to deal with the claim. According to the experience, this paper analyzes some claims and discusses the practical case projects.
