摘要
随着研究的不断深入,对法律方法论的研究,不但学科意识明显增强,而且研究的实践意识、本土意识、问题意识、判例研究意识等日趋明显。2008年法律方法论的研究更加重视法律方法论回应实践能力的提高。在此基础上,对基本问题的研究继续推向深入,从多个角度体现了对法治实现途径的关怀;法教义学的立场越来越明显;法律方法与法学教育相结合的趋势日益显露。2009年中国即将举办国际法哲学大会,中国法律方法论研究与发展面临更为重要的历史机遇。
With the rapid progress of legal study, legal methodology is evolving into a new discipline in China. Moreover, its concentration on and orientation towards practices, localization, problems solving and case studies has been greatly enhanced. In 2008, the responsiveness of legal methodology to practice has gained greater attention from researchers. Based on this, research on basic problems has been pushed forward, which is suggestive of the concerns from various perspectives over the pathway of rule of law. The stand of dogmatics of law is more distinct. There is also growing evidence of integration of legal methodology with legal education. With China hosting the IVR in 2009, the research on legal methodology in China is facing critical chances for development.
