摘要
建设资源节约型社会作为一项基本国策,关系着中国现代化的进程和国家安全,对促进经济的全面协调及可持续发展具有重要的意义。文章通过对法律功能优势的解析,指出了中国节约型社会建设中法律功能优势在实现过程中的不足与缺失。阐明应进行制度创新,逐步完善节约型社会法律促进机制,创造良好的法治环境,充分发挥法律的功能优势,以法治保障节约型社会的建设,以法治现代化推进法律功能优势的实现。
As a basic national policy of China, the construction of resource-saving society is concerning China＇ s modernization advancement and national security, and is very important to promote the comprehensive coordination and sustainable development of economy. The system innovation, the perfection of legal promotion mechanism of economical society, and the construction of good legal environment are the significant premise for the orderly development of the economical society construction. And it is necessary to analyze the legal function superiority and the legal promotion mechanism of economical society construction, and to recognize fully the insufficiencies and flaw of the legal function superiority in the construction of the economical society. Then we can perfect the legal function superiority, and promote the realization of legal function superiority.
