摘要
传统法律文化构成了当代中国法制现代化的历史与逻辑起点。可是 ,由于传统法律文化奠基于自然经济 ,以宗法伦理为核心 ,因而与现代法制有着明显的排斥性。传统法律文化必须经过现代转型才能成为当代法制建设的文化资源。
Chinese traditional legal culture is the logical and historical starting point of legal modernization. But the Chinese traditional legal culture is not compatible with the modern legal system because it has been based on the natural economy and has centered on the patriarchal clan system and moral principle. It must undergo the process of modern transformation so as to become the cultural resources of the contemporary legal system construction. Hence,this essay attempts to research into the necessity,possibility and approach of modern transformation.
