摘要
本文通过探讨软法问题形成的原因,引出软法这一概念的内涵和外延,从而得出结论:当代中国在重树立法律权威的同时,也要重视软法这一类法外资源,将它们引导到法律中能推动并保障法律的实施。
With the appearance of the concept and the phenomenon of soft law, widespread concerns and controversies have bccn brought up in the Chinese jurisprudential circlc. Therefore, in this article we focus on what soft law is, why it is necessary to research into this topic, and what significance it has for the construction of rule of law in China.
