摘要
研究目的:力求理顺划拨土地使用权抵押相关立法中的关系,为划拨土地使用权的政策修订提供参考。研究方法:文献资料法、理论研究法、比较分析法。研究结论:搞清划拨土地使用权的性质和归属是完善制度的根本,明确登记效力是完善土地使用权登记制度的关键,构建不动产统一登记制度是解决划拨土地使用权抵押登记及当前诸多登记问题的根本措施之一。
The purpose of this paper is to make clear the relation among the laws and acts on unremuneratively granted land-use fight mortgage and offer some references for the emending of the laws and acts about it. Methods of documentation, theoretical study and comparative analysis were employed. The results show that it is essential to make clear the character and attribute of unremuneratively granted land-use fight to improve the system. The clear definition of the registration effect is the key to improvement of the registration system. At the same time, building the uniform registration system of real property is one of the methods that would solve problems existing in the mortgage registration of unremuneratively granted land-use fight.
