摘要
抵押权法律关系的客体范围随着经济社会的持续发展而不断扩大,抵押权同样可以设定在农村房屋上,但在我国,部分障碍仍存在于农村房屋抵押权的实现上,究其原因,当前我国对房地一体原则相当遵循,无论是在实务界还是在理论界。我们必须了解唯有在固有的范围中才可使用房地一体原则,若坚持将房地一体原则使用在宅基地严禁抵押这个前提之下,便会得到严禁抵押我国农村房屋这一结论,显然与我国社会主义市场经济的发展需求不相符,所以,我们应坚持分离宅基地以及农村房屋的处分。要想实现房屋抵押权,不应与宅基地的转移问题相联系,而单以房屋所有权为基础。为此分析了怎样才能解决农村房屋抵押权的问题,为了均衡社会关系,应在租赁合同中明确宅基地与抵押权人的法律关系。
Continuous development of economy and society has expanded the scope of the objects in mortgage relationship.Mortgage can also be set on rural housing.However,the realization of rural housing mortgage is facing some obstacles caused by adhering to the principle of the integration of housing and land,which widely exists in both practical field and theoretical field.But this principle must be used in inherent scope.If we apply this principle under the premise of homestead being forbidden to mortgage,we will get the conclusion that the mortgage of rural housing in China is strictly prohibited,which is not consistent with the development needs of China’s socialist market economy.Therefore,we should insist on the separation of homestead and rural housing disposal.That is,housing mortgage only involves house ownership,and doesn’t realize the transfer of homestead.After analyzing how to better implement rural housing mortgage and considering the balance of social relations,the paper suggested that,the legal relationship between homestead and mortgagee should be clarified in the lease contract.
