摘要
宪政是研究民族自治地方立法监督的逻辑起点、理论基石和价值准则,民族自治地方立法监督制度是中国法治建设的重要环节,应在宪政原则指导下建构我国民族自治地方立法监督体系。文章从监督主体、监督对象及内容、监督形式等方面对民族自治地方立法监督制度存在的疏漏及问题进行了广泛的实证分析和探讨,以期为我国民族自治地方立法监督制度的完善提供理论指导和实践操作方法。
The constitutionalism is the logic start, theoretic base and value criterion of the legislative supervision of the autonomous region of nationality. The system of the legislative supervision is an important part of the construction of the rule of law. The construction of the system must be under the guide of the principle of the constitutionalism. This paper analyzes and explores the oversight and problems of the system from the subject, object and substance and form of the supervision to provide theoretic guide and practical method for its perfection.
