摘要
约定竞业禁止义务的产生以竞业禁止协议为其前提条件,而竞业禁止协议也是离职雇员承担约定竞业禁止义务的根本依据。竞业禁止协议的生效除了一般协议所应具有的生效要件之外,还应有一定的条件和要求限制,只有合法合理的竞业禁止协议才具有法律效力,而违反有关法律要求或违反合理性的竞业禁止协议应属无效,不具有约束力。
Promissory prohibition of business strife agreement is the premise of promissory prohibition of business strife obligation, and the promissory prohibition of business strife agreement is the basis for the demission employees to take on their obligation. Besides the conditions for the general agreements to go into effect, there are some other conditions and restrictions for promissory prohibition of business strife agreement to take effect. Only the legality and reasonable promissory prohibition of business strife agreement has force and effect and those promissory prohibition of business strife agreement which offend the law or go against rationality belong to invalidation agreement, and has no sanction.
