摘要
专家责任的性质界定在国内外的立法、司法及理论界都是一个热点问题。本文通过对专家责任契约性分析,明确在合同基础上专家注意义务的判断标准,指出专家在提供专业服务过程中亦应对委托人之外的特定第三人承担合理的注意义务,以达到专家职业利益和社会公共利益双赢的目的。
The character of experts＇ liability is a hot topic in legislation, justice and legal theory. Through the analysis of experts＇ contmet liability, this article verifies the judgement standard of expert duty of care on the foundation of contract, points out the reasonable duty of care to a certain third party except client in the course of expert professional service, aims at realizing double wins between expert professional benefit and social public benefit.
