摘要
我国体育冠名权现象的出现和兴起,是社会体育和体育经济发展的必然产物,成为一种常见的体育商业交易形式和法律权利现象。作为一种新兴的种类,体育冠名权是指体育单位、法人及特殊的自然人组合,对拥有社会认知性的所属物名依法转让,以使受让人享有名称传播的权利,主要包括体育商业性冠名和纪念性冠名两种类型。文章提出我国体育冠名权的法律保护对策,为我国体育冠名权市场交易向规范化、法制化轨道运行提供理论借鉴。
Appearance and rise of the name right phenomenon of sports of our country, is the inevitable result of social sports and sports economic development, become a kind of common commercial trade form of sports and legal right phenomenon. As a kind of new developing kind, the sports name right refers to the association of sports unit, legal person and special natural person, transfer the affiliated thing name with social cognition in accordance with the law, so that the assignee enjoys the right that the name spreads. Mainly include two types of conunercial naming of sports and commemorative naming. The normal need that and legislate that not only the sports industry's theoretical research, but also dialysis the social sports phenomenon, prerequisite of clarifying merits at the same time.
