摘要
加入世贸组织意味着我国最终将加入GPA开放政府采购市场。为此,我们必须在立法上有所准备,在采购的法律制度和运行规则上与国际接轨。本文从政府采购的立法取向、法律适用范围等方面对WTO政府采购协议与中国政府采购立法进行了比较分析,并对中国政府采购立法与WTO政府采购协定的整合提出应采取的对策。
After joining the World Trade Organization （WTO）, China will eventurally sign the Government Procurement Agreement （GPA） and open the government procurement market toward the world. So something must be done in our legislation to prepare for it, the regulation system in the government procurement and its running rule should fit the common requirement of international procurement law. This paper, from the view of legislations and the scope of the government procurement, compares and analyzes the GPA and the legislations of the government procurement in China, and then proposes some countermeasures for the coordination between the legislations of the government procurement in China and the GPA.
