摘要
在我国刑事诉讼制度中确立诚信机制有如下意义:弥补诉讼立法资源的不足;顺应刑事诉讼民主的要求;符合现代社会对司法行为的要求;有效防止诉讼权利的滥用。诚信原则在刑事诉讼语境下的基本含义包括两个方面:一是它要求诉讼主体正直、诚实地实施诉讼行为,不损害其他诉讼主体的利益,不能以极端或过分的方式行使诉讼中的程序权利或实体权利;二是当行为主体确信其行为符合法律,且从主体产生这一确信的过程看,他是诚实无过错的,主体基于这一确信作出了相应的诉讼行为,法官可赋予这些行为有利的待遇。
The meanings of establishing the integrity system in Chinese criminal procedure is as follow: to make up for the shortage of legislation resources in criminal procedure area; to conform to the requirements of democracy in criminal procedure; to accord with people's requirements towards the judiciary in modern society; to prevent the abuse of litigants' rights effectively.
