摘要
我国民法存在漏洞和体系不完善之处, 因而司法实务中要采取类推适用等方法加以补充。在我国当前的司法实务中, 民法类推主要有法律规定的类推和法律转移的类推两种类型; 而判例类推将是我国今后民法类推适用中普遍采用的方法。
There are some weak points in Chinese Civil Law and the system is not perfect. So we need to use analogy suitability to supplement it in judicial practice.There are two major types in civil law’s annlogy……stipulated analogy by law and shifted analogy by law,however,precedented analogy is the universal way in civial law’s analogy suitability in the future.
