摘要
现代意义上的惩罚性赔偿制度源于英美法系国家,并广泛适用于侵权案件和合同及产品责任领域。它是一种与补偿性赔偿、精神损害赔偿不同的承担责任方式。惩罚性赔偿制度具有赔偿、制裁、威慑和激励等功能,充分体现了对人的关怀和尊重。我国应全面建立起符合国情的惩罚性赔偿制度。
Punitive indemnity system.in modem sense,stems from such countries as England, America,and France,etc. and widely adapts to the fields of tort cases and contracts and products responsibility. It is a kind of bearing responsibility different from compensating indemnity and spiritual hurt indemnity. Punitive indemnity system has the functions of compensating, sanction, deterrence and incentives etc,showing full respect and for human beings. We should establish all-round punitive indemnity system which is suitable for our national conditions.
