摘要
《元剧选》中以及明代的公案剧在原则上赞美清官司法的同时 ,不经意中也展示了这一司法人治模式的一系列局限 ,展现了这一模式的另一如今容易为人忽视的侧面 :司法错误的严格责任 ;但这种严格责任不仅很难带来司法的改善 ,相反 ,在一定条件下 。
In the Drama Anthology of Yuan Dynasty and the legal case dramas of Ming Dynasty, honest and upright officials are usually admired and a series of limitations on the pattern of the rule of man are also showed unconsciously. And another side of the pattern that is easily ignored nowadays is the strict responsibility for judicial error. However, such kind of strict responsibility is hard to bring about the judicial improvement. In some circumstances, it may make the ancient officials more irresponsible.
