摘要
对建立我国体育仲裁制度的一系列相关问题与基本关系进行了系统的研究 ,在对体育仲裁进行界定和对国外体育仲裁情况进行介绍的基础上 ,对建立该制度的必要性和可行性进行了全面的分析 ,指出了建立制度的有关原则 ,重点对有关法律依据 ,体育仲裁性质、范围、机构设置、程序和效力以及涉外体育仲裁等难点问题进行了法理分析 。
This paper makes systematic study on a series of problems about establishing sports arbitration system.Based on sports arbitration definition and introduction on condition of sports arbitration abroad,the author comprehensively studies the necessity and feasibility of establishing sports arbitration system,points out relative principles especially legal basis,sports arbitration nature,range,institution,procedure,efficacy and problems related to foreign cases.Countermeasure and suggestion for establishing sports arbitration system are put forwarded.
