摘要
法院体制行政化已成为影响我国司法独立和司法公正的核心因素 ,具体表现在以下几个方面 :法院机关地位的行政化 ;法官制度的行政化 ;审判业务的行政化 ;审级间的行政化 ;法院机关职能的行政化。法院体制行政化造成了以下弊端 :为行政权干涉司法权提供了可能 ;严重影响了法官的独立审判 ;严重威胁到审级监督体系 ;严重影响了司法公正。为了克服这些弊端应采取下列对策 :实现司法行政和司法审判的分立 ;实行新的司法机关人事制度 ;革新案件审理体制 ,保障法官独立行使职权 ;建立新的司法机关党务领导体系 ;确立新的司法机关后勤财政管理体系 ,消除上下级司法机关的行政性关系 ;
Administrativity in the court of law has become the key factor affecting judicial independence and justice in our country. The administrativity of the court manifests in the status of the court as an executive department, in the justice system, in trial procedure, in the hierarchy of trial and in the function of judicial institutions. The administrativity of the judicial system has caused so many malpractices that it offers possibility for the executive to interfere with the judicial, that the justice’s independent trial is seriously affected, that the work of the hierarchy of trial and the supervision of trial are severely threatened and that the justice of the judiciary is badly disturbed. To remove all these malpractices, the judicial administration should be separated from the judicial trial; a new personnel system should be introduced for the judiciary; the trial procedure of cases should be innovated so that the justice can play his part independently; a new leadership of the Party affairs of the judicial institutions should be established; a new administrative system should be established in charge of finance and rear service; the executive relation between the superior and the inferior of judicial institutions should be removed and an all-round supervision should be introduced over judicial institutions.
