摘要
迄今为止,权力制约途径主要有二:一是"以权力制约权力",二是"以社会制约权力"。从福柯式的权力立场出发,对权力的法律化概念进行了反思,以此为起点,检讨了西方权力制约的两条途径。其中,认为立法权、行政权与司法权的分立与制衡构成了"以权力制约权力"的核心,而"以社会权力制约国家权力"则成为现代西方权力制约途径的发展趋势。最后,文章指出,西方的权力制约途径既有宏观的,也有微观的,西方现代社会的权力制约权力途径已形成了一项系统性机制。
The way of power checking in the West so far has principally two aspects: 'power checks power', and 'society checks power'. The article reconsiders the definition of the law of power from the stand of Foucault on power, and based on it, the author reviews two principal ways of power checking in the West. The article thinks that the checks and balances of the legislative, executive and judicial power constitutes the core of 'power checks power', and 'social power checks state power' becomes the developing trench of power checking in the modern West. At last, the article argues that there are not only macro-way, but also micro-way. The way of power checking has turned into a kind of systematic mechanism.
