摘要
权利本位是法治国家的明显特征,权利本位既是历史发展的必然,也是法治国家的实质要求。而要做到对权利的切实保障,加强权利本位观念,就必须对威胁权利的潜在因素即权力加以限制,因此对权力进行制约是法治国家的重要保障。只有建构起一种权利与权力的良性互动机制,才能真正实现法治国家所追求的正义与公正。
In this paper,the essence of rule of law is discusses in two aspects,namely the right standard and the power restriction.It points out the obvious characteristics of legal state is right standard,which is not only a historical inevitability,but also an essential demand of legal state.In order to offer practical guarantee for the right and enforce the concept of right standard,the power as potentially threat to the right must be limited,and thus power restriction is the most important guarantee for realizing legal state.Only by constructing an interaction mechanism between right and power,then can really realize the justice and fair pursues of legal state.
