摘要
"鸟巢"是国家体育场的通俗名称,作为北京奥运会主场馆,鸟巢承载着中国人百年奥运的光荣与梦想,体现着中国人心中的独特文化象征价值,吸引了众多企业将"鸟巢"的形象与企业标志和产品形象融汇在一起进行宣传。本文考察了各种对鸟巢侵权的现象,分析了鸟巢无形资产保护中存在的法律问题,并从完善建筑作品形象权立法和成立体育场馆著作权保护集体组织等方面提出了鸟巢无形资产保护的途径。
This paper explores the phenomenon of infringement of intangible assets of "Bird Nest".It analyzes the legal issues exist in the protection of "Bird Nest" and provides some protective methods for the intangible assets of "Bird Nest".
