摘要
本文利用配价语法理论分析了目前立法文本中"有下列情形(行为)之一的"句式中的"的"字结构,认为此句式的规范用法为:总说中"有下列情形(行为)之一"后应该加"的",构成"的"字结构;而分述中所列分项不应以"的"字结尾构成"的"字结构。此句式的使用应该引起立法学者的注意。本文还探讨了此句式的来源及发展演变。
Using valency theory,this paper explores the Chinese de construction in the sentence pattern you xialie qingxing(xingwei) zhiyi de(that which regards one of the following cases/acts) which is frequently found in legal documents.The results show that de should be retained in a general statement,and dropped in a specific statement.The retention or the omission of de deserves due attention from legal documents writers.In addition,the origin and evolution of the pattern are also discussed.
