摘要
处于变革时代中的国际法自身也在发生着深刻的变化,它既关注国际共同体利益保护,也更加重视个人权利的保护,程序正义原则在后2012时代进一步彰显,这些变化也影响着传统的领事法内容。《维也纳领事关系公约》第36条规定的领事通知权已经被广泛接受为一项个人权利,围绕着该权利的保护,领事保护制度也在形成和发展中。结合当前最新的国际法院的司法实践,领事保护已经从职能逐步被特定化,领事保护的内容被进一步丰富,国家的通知义务被强化,权利主体被进一步廓清,国际救济和国内救济方式还在发展,领事保护制度已经基本形成,并将对各国国内立法和实践产生重要影响。
In the era of change, international law itself is undergoing profound changes. It not only pays focus on the protection of the interests of the international community, but also on the protection of individual rights. The principle of procedural justice is further manifested in the post-2012 era. These changes also affect the content of traditional Consular law. The consular notification right under Article 36 of the Vienna Convention on Consular Relations has been widely accepted as an individual right. Around this protection, the consular protection system is also being formed and developed. Combining with the latest judicial practice of the International Court of Justice, consular protection has been gradually specified from its functions, the content of consular protection has been further enriched, the notification obligation of the state has been strengthened, the subject of rights has been further clarified, and international and domestic relief methods are still developing. The consular protection system has basically been formed and will have an important impact on domestic legislation and practice in various countries.
