摘要
分家契约是民间契约的重要组成部分,近些年来对分家契约的研究开始逐渐增多。但是大部分研究多从历史学的角度进行分析,以试图揭示在社会生活中普遍存在的各种经济制度,建构基于民间契约为根据的社会经济史。试图另辟蹊径,采用法人类学的研究方法,以云南的31份分家契约作为分析样本,将清至民国时期云南分家契约进行一些社会文化方面的分析。分析尽管以31份分家契约的文本为基础,但也不仅仅局限于文本。始终将分家契约置于特定的历史语境和社会文化中进行分析,从而揭示分家契约基本结构和内容的社会学基础,以及其所具有的诸多重要的社会功能。
The family separation contract is an important part of the civil contract.In recent years,the research on the family separation contract has gradually increased,however,most of the researches are analyzed from the perspective of history,trying to reveal the various economic systems prevalent in social life and construct the social and economic history based on the folk contract.Tries to find a new way by using the research method of legal anthropology and taking 31 family separation contracts in Yunnan as samples to analyze the social and cultural aspects of the separation contract in Yunnan from the Qing Dynasty to the Republic of China.Although the analysis is based on 31 separate contract texts,it is not limited to texts only.Always analyzed the family separation contract in the specific historical context and social culture,thus revealing the sociological basis of the basic structure and content of the family separation contract,as well as its many important social functions.
