摘要
经过30多年的发展,我国"案例指导审判"研究成果丰硕,但众多智识资源却处于无序集合状态,亟须进行知识管理。运用CiteSpace科学知识图谱工具,对1986—2018年CNKI数据库中1572篇期刊论文进行可视化分析。在知识结构上,"案例指导审判"研究形成以"司法统一""规范运行"等聚类主题的知识网络。在历时演进上,"案例指导审判"研究经历了"观念孕育"—"制度生成"—"规范运作"的知识转型。在前沿问题上,"案例指导审判"研究体现出重则恒重、稳中有变的特征,"规则发现""案例验证"等传统热点因其"可成长性"仍处于前沿位置,"案例适用"正在成为新的知识增长点。但同时也存在泡沫性研究较多、研究发现滞后于制度实践等问题。立足司法需求侧,从审判经验中汲取新鲜知识资源,反哺案例指导规则优化,丰富案例指导的类型、范围与方法技术,提升案例产品的适用效益,"案例指导审判"研究在未来还有很大的知识跃升空间。
The study of"case guiding trial"has achieved fruitful results during 30 years.However,many intellectual resources are in a state of disordered collection,which calls for knowledge management.We analyse 1572 journal papers on this theme in CNKI from 1986 to 2018 by using the CiteSpace which is a scientific knowledge map tool.It is found that the study of"case guiding trial"has formed a multilevel knowledge network system with seven clustering centers,such as"judicial unification","standard operation","legal effect",etc.The key knowledge transfer from"conception breeding","system generation"to"standard operation".The frontiers in this theme are constant steady though there are some changes.Traditional hot spots such as"rule discovery","case verification"and"legal effect"are still at the forefront due to their growth potential,and"case application"is becoming a new growth point.However,there exist some foamy research and generally the study is lag behind the practice.From the perspective of judicial needs,we should draw knowledge resources from trial experience,enrich the type,scope,and methodology of case guidance,to improve the application of case guiding.After all,there is still great room for knowledge leap in the study of"case guidance trial"in the future.
