区块链电子数据的证据能力分析——以农业保险欺诈刑事诉讼切入 被引量:8

Analysis on the Evidential Ability of Blockchain Electronic Data: from the Perspective of Criminal Litigation of Agricultural Insurance Fraud

摘要 由于政策性农业保险的利益诱惑,虚假投保和虚假理赔成为农业保险欺诈的主要方式。虽然农业保险区块链应用系统通过精准投保和智能理赔模式实现了农业保险业务和财政补贴资金的事前和事中监管,缓解了监管时滞,预防了保险欺诈,但是区块链电子数据在农业保险诈骗刑事诉讼中的证据能力还有待检验。传统电子证据的虚拟性、技术性、多样性、不稳定性、易篡改性使其在司法实践中采信率较低,电子证据能力经常附属于证明力,出现电子证据能力虚无化的趋势。区块链的防篡改、可追踪特点可在技术上简便、可靠地证明电子数据、电子证据内容、电子证据载体的真实性,不仅能够促进电子证据在刑事诉讼中的采信率逐渐提升,推动农业保险高质量发展和乡村振兴,还可在一定程度上拟合证据法认识论与价值论对诉讼认识活动的认知分歧。 Due to the interest temptation of policy agricultural insurance,false insurance and false claims become the main ways of agricultural insurance fraud.Although the agricultural insurance blockchain application system puts into trial implementation of pre and in-process supervision through precise insurance and intelligent claim settlement mode to agricultural insurance business and financial subsidy,so as to alleviate regulatory delay and prevent insurance fraud,the evidence ability of blockchain electronic data in criminal proceedings of agricultural insurance fraud remains to be tested.The traditional electronic evidence’s virtuality,technicality,diversity,instability,and easy to tamper with make it low credibility in judicial practice.The ability of electronic evidence is often attached to the force of proof,which leads to the feeble trend of electronic evidence ability.The tamper proof and traceable features of blockchain can prove the authenticity of electronic data,electronic evidence content and electronic evidence carrier simply and reliably in technology.It can not only promote the gradual increase of the credibility of electronic evidence in criminal proceedings,but also fit the cognitive differences between evidence law epistemology and axiology on litigation cognitive activities to a certain extent,and promote the high quality of agricultural insurance development and rural revitalization.
