摘要
自《家庭教育促进法》实施以来,全国各地多家法院陆续发出了家庭教育令。本案是武汉市首例在离婚纠纷中发出家庭教育令的案件,为普法工作提供了司法先行的创新示范。本案裁判首次明确了家庭教育令的发出条件。同时,家庭教育令的法律性质、执行程序、救济程序等问题,也值得我们进一步思考。
Since the implementation of the Law of the People’s Republic of China on Family Education Promotion,many courts throughout the country have successively issued the family education order.This case is the first case in Wuhan to issue the family education order in divorce disputes,which provides an innovative demonstration of judicial practice for law popularization.The judgment of this case made clear for the first time the issuing conditions.At the same time,the legal nature,execution procedure and relief procedure of the Family Education Order also deserve our further consideration.
