摘要
“踩点减刑”是一种报请减刑之日虽然位于惯常的起始时间或间隔时间届满点后,但是相隔较近的刑罚变更执行现象。实践中,“踩点减刑”一直未被准确界定,以致被标签化。从实体与程序之维对其进行考察,“踩点减刑”并非全部违法或不适当。对减刑认识的偏差、裁量标准的不明确、办案模式的不严谨,是一些不适当或违法的“踩点减刑”形成的主要原因。对此,需要树立科学合理的减刑观,规范考核期延长方案与日常管理考核,健全监狱减刑案件办理程序机制,确保刑罚变更执行的公平公正。
“Commutation by Step on the Spot”is a phenomenon that the date of applying for commutation is near the end of the usual starting time or interval.In practice,“Commutation by Step on the Spot”has not been accurately defined,so that it has been labeled.From the perspective of substance and procedure,it is not all illegal or inappropriate to“Commutation by Step on the Spot.”The main reasons for the formnation of some inappropriate or illegal“Commutation by Step on the Spot”are the deviation of understanding of commutation,the ambiguity of discretion standard and the lax mode of handling cases.In this regard,we need to establish a scientific and reasonable concept of commutation,standardize the assessment period extension scheme and daily management assessment,improve the mechanism of handling prison commutation cases,and ensure the fairmess and justice of the implementation of penalty changes.
