摘要
企业化是全球有组织犯罪发展的一个共同趋势。我国有组织犯罪在不同的发展时期,其企业化程度和表现有所不同,但在总体上呈现快速发展之势。有组织犯罪的企业化发展导致在有组织犯罪与公司企业犯罪的界分、犯罪组织中参加者和企业员工的区分、涉案财产的处置以及国际刑事司法合作等方面存在疑难问题,从而使相关刑事司法陷入困境。针对有组织犯罪企业化趋势带来的刑事司法问题,应当深刻把握有组织犯罪的发展规律,贯彻科学司法;规范反有组织犯罪的司法活动,坚持依法司法;科学预测有组织犯罪的发展趋势,加强国际司法合作。
Corporatization is a common trend in the development of global organized crime.Organized crime in China has different degrees of corporatization and performance in different periods of its development,but on the whole it is showing a trend of rapid development.The corporate development of organized crime has led to difficulty in the distinction between organized crime and corporate crime,the scope of the property involved in criminal cases,the distinction between participants and corporate employees in criminal organizations and the procedures for the disposal of the property involved.In response to the criminal justice issues arose from the corporatization of organized crime,we shall master the law of the development of organized crime,implement scientific justice,regulate judicial activities against organized crime and adhere to justice according to law,scientifically predict the development and trend of organized crime and strengthen international judicial cooperation.
