摘要
最高人民法院以指导性案例的形式明确了学位授予纠纷的司法审查限度,当前司法实践也以此为基准,对纠纷中的学位授予标准奉行学术标准有限审查和非学术标准全面审查的原则。和目前已决的学位授予纠纷存在明显不同,“柴丽杰案”涉及高校二级学院的自治权与司法审查权之间的冲突:高校学术自治具有必要性和正当性,二级学院可在获得学校授权的情况下,设定严于校规的学术标准,这仍属于学术自治范畴。对此,司法机关应当保持足够的谦抑和尊重,只要不违反比例原则和正当程序原则,即可肯定二级学院规则具有完备的法律效力。
The Supreme People's Court clarified the limits of judicial review for degree-granting disputes in the form of guiding cases,and the current judicial practice also serves the rules as a benchmark.For the degree-granting standards in disputes,it pursues a limited review of academic standards and a comprehensive review of non-academic standards.It is obviously different from the disputes about degree awarding that have been settled so far,the“Chai Lijie Case”involves a conflict between the autonomy of secondary colleges and judicial review.Academic autonomy of colleges and universities is necessary and legitimate.Secondary colleges can set academic standards that are stricter than school regulations when they are authorized by the school level.This still belongs to the category of academic autonomy.In this regard,the judiciary should maintain sufficient humility and respect.As long as the principle of proportionality and the principle of due process are not violated,it can be affirmed that the rules of the secondary colleges have complete legal effects.
