摘要
在我国的教育体系中,职业教育占据着重要地位。新修订的《职业教育法》明确了职业教育是与普通教育同等重要的教育类型,这代表着公民受职业教育权作为宪法所规定的公民受教育权的延伸与细化,需要国家提供保障,而国家保护义务的履行则是受职业教育权保障的根本所在。公民受职业教育权的基本权利属性是国家为其提供保护义务的法理基础,公民受职业教育权的双重权利性质为国家保护义务主体法律关系的梳理提供了思路。公民受职业教育权的国家保护义务主要分为侵害预防、侵害排除、侵害救济三个层次,其保护范围则由受职业教育相关权利生成路径所决定。
Vocational education occupies an important position in China's education system.In the newly revised Vocational Education Law,vocational education has been made clear that it is the equally important education type as general education,which represents the extension and refinement of citizens'right to vocational education as a constitutional right to education needs to be guaranteed by the state,and the fulfillment of the state's protection obligation is fundamental to guaranteeing the right to vocational education.The basic right attribute of citizens'right to vocational education is the legal basis for the state to provide protection obligations.The dual nature of citizens'right to vocational education provides ideas for sorting out the subject-legal relationship of the state's protection obligation.The state's protection obligation of citizens'right to vocational education is divided into three levels:infringement prevention,infringement exclusion,and infringement relief.The scope of its protection is determined by the generation path of the rights related to vocational education.
