摘要
由于《民法典》对网络虚拟财产保护的规定过于原则而无具体规则可供执行,故实践中网络平台提供方限制网络虚拟财产转让的单方规定便往往成为法院裁判网络虚拟财产转让有效与否的依据。网络平台提供方对网络虚拟财产转让予以限制的单方规定既不合理,也不合法。只有取缔网络平台对虚拟财产转让的限制,规范好虚拟财产转让的方式,完善其必要的登记及公示制度,制定交易的相关规则,虚拟财产所有人的财产权利才能得到全面的保护。
Because the provisions of the Civil code on the protection of network virtual property are too principled and no specific rules can be implemented,the unilateral provisions of the network platform provider restricting the transfer of network virtual property in practice often become the basis for the court to judge whether the transfer of network virtual property is effective or not.The unilateral provision by the network platform provider to restrict the transfer of virtual property on the internet is neither reasonable nor legal.Only by abolishing the restrictions on virtual property transfer imposed by online platforms,standardizing the methods of virtual property transfer,improving the necessary registration and publicity systems,and formulating relevant rules for transactions,can the property rights of virtual property owners be fully protected.
