摘要
我国建立国家公园的首要目的是保护好自然生态系统的原真性、完整性,同时也要为公众提供亲近自然、体验自然、了解自然的游憩机会。通过开展特许经营,为访客提供必要的游憩条件,能够有效弥补财政经费不足,带动当地经济社会发展,并缓解社区矛盾,更有助于提高国家公园旅游服务水平和公众环境意识。分析国家公园特许经营的作用及其法律规制的主要内容,总结我国国家公园特许经营的现状和问题,提出了我国国家公园特许经营法律规制的难点及建议。
The primary purpose of establishing national parks in China is to protect the naturalness and integrity of the natural ecosystems,and at the same time,to provide recreational opportunities for the public to get close to nature,to experience and to understand nature.By carrying out concessions to provide visitors with the necessary recreational conditions,it can effectively compensate for the lake of financial resources,drive local economic and social development,and alleviate community conflicts,and is more conducive to improving the level of National Park tourism services and public environmental awareness.This paper analyzes the role of National Park concessions and main contents of its legal regulation,summarizes the current situation and problems of National Park concessions in China,and puts forward the difficulties and suggestions of the legal regulation of National Park concessions in China.
