摘要
自2012年我国《刑事诉讼法》第52条正式确立行政证据入刑制度,我国行刑衔接案件证据使用一直争议不断,争议主要集中在证据收集主体是否合法、限定准入证据种类是否合理、瑕疵证据作定案依据是否失实这三个方面。为使行刑案件衔接更流畅,应当从问题成因出发,确立摒弃证据提交主体资质审查、正确理解证据种类、发挥"非法证据排除规则"屏障作用,把握庭审实质的行刑衔接证据适用的应然选择。
Since Article 52 of the Criminal Procedure Law of 2012 formally established the administrative evidence entry system,the use of evidence in China’s execution of the sentence has been controversial.The dispute mainly focuses on whether the subject of evidence collection is legal,whether the type of evidence for admission is reasonable,and the evidence is Whether the basis for the decision is inaccurate or not.In order to make the execution of the execution case more fluent,we should proceed from the cause of the problem,establish the rejection of the evidence submitted to the subject qualification review,correctly understand the types of evidence,play the role of "illegal evidence exclusion rules" barrier,and grasp the appropriate choice of the application of the evidence of the execution of the trial.
