摘要
红色经典作品版权纠纷折射的,是革命法律传统孕育出的无须权利的“红色”版权观念与以权利为中心的个人主义版权观念之间的冲突,但不同法律传统之间并非无法实现整合。对红色经典作品版权纠纷进行考察可以发现,法官运用法律适用技术与事实认定技术建立了革命文艺作品创作利益分享机制。当代著作权法律制度虽然为不同法律传统之间关系问题的处理提供了一系列基本的法概念和符号,但法律规范并未起到对人的行为的规范指引效应,反而是法官证立革命法律传统的正当性时所策略性运用的资源。在这种互动关系中,人民司法将不断赓续革命法律传统。
Copyright disputes over revolutionary classical works reflect the conflict between the rights-free“red copyright”conception nurtured by the revolutionary legal tradition and the rights-centered individualistic copyright conception of the West,but the integration between different legal traditions is not impossible.An examination of copyright disputes over revolutionary classical works reveals that judges have used the methods of law-application and fact-finding to establish mechanisms for sharing the benefits brought by revolutionary classical works.While the contemporary copyright legal system deeply influenced by the western individualistic legal tradition provides a set of basic legal concepts and symbols to describe the relationship between different legal traditions,legal norms do not mainly play a normative guiding role in human behavior,but rather are resources that judges use strategically to justify the revolutionary legal tradition.The People's Judicature perpetuates the revolutionary legal tradition.
