摘要
法学学科体系、学术体系和话语体系(“三大体系”)建设是当下中国法学界面临的重要研究任务。由于法学界长期缺少对科学学意义上的“法学学”知识体系、方法论和价值功能的研究,于是法学“三大体系”理论研究被局限在传统法学理论的框架内,无法得到有效拓展。要真正走出法学“三大体系”建设理论研究的误区和困境,关键是要把法学作为一门科学,根据科学学的原理和方法论来构建“法学学”,并通过科学有效地运用“法学学”方法论来全面系统地研究法学学科体系、学术体系和话语体系之间的价值关系和逻辑联系,只有这样才能在中国自主的法学“三大体系”理论研究上真正有所突破,确保法学“三大体系”理论研究的真实性和有效性,为提升中国法学研究整体水平提供必要的理论基础和有效的方法论。
The construction of the discipline system,academic system,and discourse system(“three systems”)of legal science is an important research task facing the current Chinese law circle.Due to the long-term lack of research in the law circle on the knowledge system,methodology,and value function of“science of legal science”in the sense of science of science,the theoretical research on the“three systems”of legal science is limited within the framework of traditional legal theory and cannot be effectively expanded.To truly overcome the misconceptions and difficulties in theoretical research on the construction of the“three systems”of legal science,the key is to treat legal science as a science,construct“science of legal science”based on the principles and methodology of science of science,and comprehensively and systematically study the value relationships and logical connections between the discipline system,academic system,and discourse system of legal science through the scientific and effective application of the methodology of“science of legal science”.Only then can there be a real breakthrough in the theoretical research of autonomous China’s“three systems”of legal science,ensuring the authenticity and effectiveness of the theoretical research of the“three systems”of legal science,and providing a necessary theoretical basis and effective methodology for improving the overall level of Chinese legal research.
