摘要
企业合规后再次犯罪是涉案企业合规改革面临的新问题。企业合规后再次犯罪有别于累犯、再犯,是指涉案企业经过合规整改后再次犯罪。企业合规后再次犯罪的原因可能有初次合规计划的自身因素,即未能建立有效的合规计划或合规计划的效果范围有限;也可能有初次合规计划的实施因素,即未能持续有效实施合规计划。对于合规后再次犯罪的企业,不应一概地排除再次适用涉案企业合规,应当回归合规制度的设立初衷与价值追求考察其具体适用。
Enterprises re-offending after compliance is a new problem faced by the compliance reform of case-involved enterprises.Enterprises re-offending after compliance is different from recidivism and repeated crime,which refers to the fact that the involved enterprise has committed a crime again after compliance rectification.The reason for a company committing re-offending after compliance may be due to the inherent factors of the initial compliance plan,namely the failure to establish an effective compliance plan or the limited scope of effectiveness of the compliance plan;There may also be implementation factors for the initial compliance plan,namely the failure to continuously and effectively implement the compliance plan.For enterprises re-offending after compliance,it should not be completely ruled out that the involved enterprise's compliance should be applied again.The specific application of the compliance system should be examined based on the original intention and value pursuit of its establishment.
