摘要
合作金融异化与合作金融发展滞后的根本原因是监管中政府的定位不清。我国农村合作金融的法律地位应属于"合作性"金融机构而非银行业金融机构。农村合作金融的监管权配置应实行中央和地方金融监管权分权的模式,监管权力主要以地方为主;中央监管权的范围应以"成员封闭、业务封闭、不以营利为目的"和成员的根本权利保障为界定标准。在合作金融与政府之间的关系中,应恢复合作金融民办、自治、自立、民主管理的本质。监管框架设计应以此为切入点,形成中央监管权、地方监管权和农村合作金融组织自治权的纵向分权,以及合作金融组织垂直的自控式监管体系,以便将监管风险化解于内部。
The legislation of rural cooperative finance in china should be oriented to clarifying the"Cooperativeness",but not the banking financial institutions.The regulation of rural cooperative finance should implement the decentralization between central and local financial regulatory powers,in which mainly focusing on the local level and the scope of the central regulatory power should be limited to the fundamental issues such as"closed members,closed business,non-profit-oriented"and the safeguarding of the fundamental rights of members.The unclear orientation of the government is the fundamental reason for the alienation of cooperative finance.And in the relationship between cooperative finance and government,the essence of private,autonomous,independent and democratic management of cooperative finance should be restored,which should be the breakthrough point for the design of regulatory framework so as to form the vertical distribution system of central power,local power and autonomy in the regulation of new rural financial cooperatives and form vertical self-controlled regulation and dissolve risks into the interior of the organizations.
