摘要
近年来,国际社会对投资者-东道国争端解决机制(ISDS)的批评愈发激烈,ISDS机制的改革已经提上日程。当前,设立上诉机制和建立常设投资法庭是认可度与可行性较高的改革方案。但是,鉴于各国对于ISDS的改革存在较大的分歧,国际投资争端解决机制在多元利益格局的影响下可能将向多元生态方向发展,我国的"一带一路"争端解决机制也有可能成为其中的生态之一。从守正与创新的视角来看,国际投资争端解决要应对碎片化的趋势,应当尊重投资争端解决机制改革的规律性,并实现新旧规则的借鉴与弥合。在此过程中,我国也应当通过积极构建"一带一路"争端解决机制,贡献国际投资争端解决多元生态,并及时抢占话语高地。
In recent years,the international community has increasingly criticized the Investor-State Dispute Settlement(ISDS),and the reform of the ISDS mechanism has been put on the agenda.At present,the appellate mechanism and the multilateral investment court are highly recognized and feasible reform programs.However,considering the discrepancies among different countries on ISDS reform,ISDS may develop towards a multi-ecology direction under the influence of the diversified interest.China’s"Belt and Road"dispute settlement mechanism may also become one player in the ecology.From the perspective of past achievements and innovation,in order to deal with the fragmentation in international investment dispute settlement,the regularity of the reform should be respected,the old and new rules should be bridged.In this process,China should also actively build a dispute settlement mechanism for the"Belt and Road",in order to contribute to the multi-ecology of international investment dispute resolution,and seize the speech high ground in a timely manner.
