摘要
现场执法是警察的基本活动。中外警察因在自行处置权、强制权行使及证据使用规范等方面存在的差异而形成了截然不同的现场执法模式。虽然我国警察现场执法有自己的特色和优势,但对比发现,由于我国相关法律法规的表述较模糊,警察行使盘查权的法律依据不够具体,搜身权方面对个人隐私、尊严的保护还存在欠缺;在强制权行使方面,对警察人身安全的保护存在缺陷;在证据使用方面,"非法证据排除规则"还不够健全。因此,我国应当进一步细化有关警察现场执法的法律法规及执法程序;从内外两方面对警察执法行为进行监督;多方面保障警察的合法权益不受侵犯;借鉴吸收国外执法程序规则的优点,实现实体正义与程序正义的平衡。
On-site enforcement is the primary work of the police.The police are given arbitrary power and coercive power in different degrees in and abroad China,as well as the evidence implementation,which results in divergent patterns of police on-site enforcement.Compared with foreign countries,for the relevant legal descriptions in China are ambiguous,the legitimate basis for stop-and-frisk is not sufficient and the police right to search violate individual’s privacy and dignity.When enforcing the arbitrary power,the personal safety cannot be fully protected.As to evidence implementation,the rules for exclusion of illegal evidence are not complete.Therefore,the rules and enforcement procedures concerning police on-site execution should be refined.Police enforcement actions should be under supervision by interior and exterior authority.Personal safety and lawful rights of police officers should be guaranteed by many measures.Entity justice and procedural justice shall be in balance taking advantage of foreign rules of enforcement procedure.
