摘要
彩礼是我国传统婚俗的组成部分。现行法律对彩礼概念及法律性质的认定较为模糊,对彩礼返还规则的设计较为简略,无法满足解决彩礼返还纠纷实务需要。基于《民法典》所倡导的公平诚信、守法与公序良俗等基本原则,对彩礼返还制度进行研究。彩礼是以成立稳定的婚姻关系为目的,由一方当事人及其家庭依良俗自愿向对方当事人及其家庭给付的财物,属于附解除条件的赠与。遵照制定法与习惯法相统一、保护婚约自由与照顾无过错方相统一、保护妇女和儿童合法权益原则,探索确定彩礼良俗范围的路径,并综合考量共同生活时间、当事人过错、生活困难程度等因素,建立彩礼返还具体规则。
Giving betrothal gifts is a part of traditional marriage customs in China.The current law on the concept and legal nature of betrothal gifts is relatively vague,and the design of the rules for the return of betrothal gifts is relatively simple,which can not meet the practical needs of solving the disputes over the return of betrothal gifts.Based on the basic principles of fairness and integrity,law-abiding,public order and good customs advocated by the civil code,the author studies the return system of betrothal gifts.Giving betrothal gifts is a kind of property that one party and his family voluntarily pay to the other party and his family according to good customs for the purpose of establishing a stable marriage relationship.It is a gift with termination conditions.In accordance with the principles of the unification of statutory law and customary law,the unification of the protection of the freedom of engagement and the care of the innocent party,and the protection of the legitimate rights and interests of women and children,the author explores the path to determine the scope of betrothal gifts,and establishes specific rules for the return of betrothal gifts by comprehensively considering the factors such as the common living time,the fault of the parties,and the degree of life difficulties.
