摘要
对乡村基层纠纷的有效治理是乡村振兴与乡村治理能力现代化的重要内容。乡村纠纷研究经历了从维权到治权的范式变化,两种范式侧重点各不相同,都蕴含着国家与社会关系理论内涵。对国家—社会框架的批判性反思,以及生活世界概念从哲学到社会学领域的内涵变化,为乡村纠纷研究的新范式即生活世界范式提供了重要参照。基于村民日常生活的文化系统以及作为村民自我观念构成的主体性,构成了生活世界范式的基本内容。河南省S乡的田野资料进一步表明,在生活世界范式下,生活世界—日常纠纷—基层治理的连续统为理解乡村纠纷治理提供了整体性的解释框架;村民主体的观念与行动,不仅构成了纠纷的内在发生机制,更是基层政府对于乡村纠纷有效治理的关键。
Effective governance of rural disputes is an important part of rural governance innovation.The study of disputes in rural China has experienced a paradigm shift from rights protection to rural governance.The two paradigms have different emphases,but they both have the theoretical framework of the relationship between the state and society.The critical reflection of the state-society framework and the interpretation of the concept of life-world from philosophy to sociology,provide an important reference for the new paradigm of rural disputes research,namely the life-world paradigm,which includes the cultural value system based on villagers’daily life,the subjectivity as self-conception.The fieldwork in S Township of Henan province shows that the continuum of daily disputes provides a holistic framework for understanding rural disputes under the life-world paradigm on the one hand.The villagers’conception of subject and the corresponding social actions not only constitute the mechanism of disputes phenomenon in rural society,but also the key to effective governance to rural disputes problems on the other hand.
