摘要
视频监控作为当下电视节目中经常应用的一种元素,来源广泛、可信度高、现场感强,能够有效地弥补新闻现场易逝性的缺憾,增强报道的权威性和可看性。然而视频监控和新闻报道毕竟有着不同的价值追求,监控影像里所蕴含的丰富个人信息在脱离权利人控制之后的传播过程中极易受到侵害,很大程度上会造成私权保障的内在隐忧。鉴于此,有必要从现实问题入手,促使视频来源、使用限度和隐私保护等方面更为规范化、制度化,以期实现在合法、适度且有节制的范围内予以使用,在公众知情权与公民人格权之间达成动态平衡。
As an element frequently used in current TV programs,video monitoring has extensive sources,high credibility and strong sense of scene. It can effectively make up for the lack of perishability of news scene and enhance the authority and readability of reports. However,video monitoring and news reports have different value pursuits after all. The rich personal information contained in the monitoring images is extremely vulnerable to infringement in the transmission process after it is out of the control of the right holder,which will cause internal worries about the protection of private rights to a large extent. In view of this, it is necessary to start with practical problems and promote the standardization and institutionalization of video sources,use limits and privacy protection,so as to realize the legal,moderate and controlled use,and finally achieve a dynamic balance between the public ’s right to know and the citizen’s right to personality.
