A brief Discussion on the Nuclear Safety Law of the People’s Republic of China——Innovation, Problems and Suggestions

摘要 作为核领域最重要的专门性法律,《中华人民共和国核安全法》(以下简称《核安全法》)的出台使"依法治核"迈出了关键性一步,填补了我国核能顶层法律的空白,对完善我国涉核法律体系具有里程碑意义。本文分析了《核安全法》的主要内容与立法创新,剖析了现有核法律体系尚未完善、制度之间缺乏统筹协调、损害赔偿制度不够细化、难以满足中国核能发展新形势下的制度需求等问题。从纵横两个方面进一步提出完善涉核法律体系,以及提高互联网时代核信息管理水平与效率、加强核安全监督管理的独立性等政策建议,以期解决现阶段核安全领域面临的问题,规范未来可能出现的安全风险,满足不同时期核安全管理的立法目的。 As the most important specialized law in the nuclear field,the promulgation of the Nuclear Safety Law of the People’s Republic of China(hereinafter referred to as the"Nuclear Safety Law"has made a crucial step forward in the"PRC practice of governing the Nuclear Safety according to law",filling the gap in the top-level law of nuclear energy in China,and has a milestone significance in improving the nuclear related legal system of China.This paper analyzes the main content and legislative innovation of the Nuclear Safety Law,and analyzes the problems such as the existing nuclear legal system is not perfect,the lack of overall coordination between the systems,the lack of refinement of the damage compensation system,and the difficulty to meet the system requirements under the new situation of China’s nuclear energy development.In order to solve the problems in the field of nuclear safety at the present stage,regulate the possible safety risks in the future,and meet the legislative purposes of nuclear safety management in different periods,this paper puts forward some policy suggestions to improve the nuclear related legal system,improve the level and efficiency of nuclear information management in the Internet era,and strengthen the independence of nuclear safety supervision and management.
