摘要
全国首例"单身女性冻卵案"再度掀起了社会性卵子冷冻话题的热烈讨论。医疗性卵子冷冻有其合理合法性,社会性卵子冷冻由于内在地蕴含着对生命伦理原则的冲击,始终伴随着伦理和法律争议。公众在接受该技术保存生育能力、有利于卵子捐赠和卵子库建立、增加生育选择方式、促进辅助生殖技术发展等优势的同时,也担忧其陷入功利化、资源分配不公、滑坡效应等困境中。对社会性卵子冷冻进行技术合理性分析和生命伦理学思考,有助于人们正视卵子冷冻技术,进而弥补、完善该技术的伦理治理和立法保护。
The first case of"egg freezing by a single woman"has reignited the hot debate over social egg freezing.Medical egg freezing has its reasonable legality,but social egg freezing is always accompanied with ethical and legal disputes due to its inherent impact on bioethical principles.While accepting the advantages of this technology in fertility preservation,egg donation and egg bank establishment,increasing reproductive choice methods,and promoting the development of assisted reproductive technology,the public will be also concerned about it may fall into the dilemma of utilitarianism,unfair distribution of resources and slippery slope.It is necessary to analyze the rationality of social egg freezing technology and examine bioethics,so that people can face up to the reasonable legal demand of social egg freezing,and then make up for and improve the ethical management and legislative protection of the technology.
