摘要
社区处于社会结构最末端的位置,其治理现代化的程度,直接影响社会治理现代化的推进。社区治理现代化必然要通过法治社区的途径得以实现。先进的社区法治文化培育,不仅是构建法治社区的应有之义,也是现代化在思想文化方面的体现,社区法治文化的提升对于实现法治社区进而达到社区治理现代化都具有重要的价值。目前的社区法治文化的滞后性体现在了社区法治文化与德治文化结合困难、多元化纠纷解决文化难以深入人心、居民作为主力的治理文化与居委会自治文化的缺失等方面。未来社区法治文化的提升应围绕构建现代化的三治社区、无讼社区、以居民为治理主力的共治社区展开,通过社区法治文化的提升带动社区治理现代化的实现。
The community is located at the end of the social structure, and the degree of modernization of its governance directly affects the promotion of modernization of social governance. The modernization of community governance must be achieved through the approach of rule of law communities. The cultivation of advanced community rule of law culture is not only a necessary part of building a rule of law community, but also a reflection of modernization in terms of ideological and cultural aspects. The improvement of community rule of law culture is of great value for realizing the rule of law community and achieving modernization of community governance. The current backwardness of community rule of law culture is reflected in the difficulties in combining community rule of law culture with moral culture, the difficulty in deepening diversified dispute resolution culture, and the lack of governance culture and neighborhood committee autonomy culture where residents are the main force. The improvement of future community rule of law culture should revolve around the construction of modern three governance communities, non litigation communities, and co governance communities with residents as the main force of governance, and drive the modernization of community governance through the enhancement of community rule of law culture.
