摘要
我国已经进入老龄化社会,对老年人提供社区医疗服务机构的上门服务是老年人急需的权益保障途径之一,2023年中办国办印发《关于进一步完善医疗卫生服务体系的意见》,对情况合适的老年人提供社区机构上门服务是进行医疗卫生服务制度优化的应有之义。社区医疗机构对老年人提供上门医疗服务尚存在城市、农村需求差距大、供求不对等、法律保障诉讼依据缺乏以及具体制度设计缺乏等问题。要完善社区医疗机构对老年人提供上门服务的相关问题法律保障,一是应从宏观原则出发,确立全面保障原则、协调发展原则、共同责任原则为提供上门医疗服务的基本原则;二是在微观上,需在立法、执法等方面来完善社会养老服务的法律保障体系。
China has entered an aging society, and providing on-site services from community medical service institutions for the elderly is one of the urgently needed ways to protect their rights and interests. In 2023, the General Office of the Communist Party of China and the State Council issued the “Opinions on Further Improving the Medical and Health Service System”, which states that providing on-site services from community institutions for elderly people in appropriate situations is necessary for optimizing the medical and health service system. There are still problems with community medical institutions providing door-to-door medical services to the elderly, such as a large gap in demand between urban and rural areas, unequal supply and demand, lack of legal protection and litigation basis, and a lack of specific institutional design. To improve the legal protection of community medical institutions for providing door-to-door services to the elderly, firstly, starting from macroprinciples, the basic principles of providing door-to-door medical services should be established, including the principles of comprehensive protection, coordinated development, and shared responsibility;Secondly, at the microlevel, it is necessary to improve the legal protection system of social elderly care services in legislation, law enforcement, and other aspects.
