PHEIC不可抗力在涉外商事合同履约中的适用问题

摘要 新冠疫情在全球范围内肆虐,对国际商事的持续健康发展造成了较大的威胁,引发了一系列的国际商事合同纠纷。国际卫生组织将新冠疫情定性为“国际关注的突发卫生事件”(PHEIC),中国全国人大法工委在法律层面上将其定性为“不可抗力”,但是由于不同法系之间的差异,世界各国对新冠疫情是否可以定性为“不可抗力”尚且存在争议。因此,即使中国国际贸易促进委员会(中国贸促会)可为相关企业提供新冠疫情作为不可抗力的事实性证明,该证明的实际效力也并非绝对化,仍需结合个案分析适用。 The global spread of the New Crown epidemic has posed a major threat to the continued healthy development of international commerce and has led to a series of disputes over international commercial contracts. The International Health Organization has characterized the New Crown epidemic as a “health emergency of international concern” (PHEIC), and the Legal Affairs Commission of the National People’s Congress of China has characterized it as “force majeure” at the legal level, but due to the differences between different legal systems, there is no consensus in the world as to whether the New Crown epidemic can be characterized as “force majeure”. However, due to the differences between different legal systems, it is still controversial whether the new crown epidemic can be characterized as “force majeure”. Therefore, even if the China Council for the Promotion of International Trade (CCPIT) provides the relevant enterprises with factual proof of the New Crown epidemic as a force majeure, the actual validity of such proof is not absolute and still needs to be applied on a case-by-case basis.
