摘要
社会契约思想在西方源远流长,影响深远。它以自由、平等、人权为基石,影响着西方宪政的产生、发展。本文从社会契约思想及其与西方宪政的关系入手,结合我国宪政中存在的某些问题进行了分析,认为社会契约思想在我国的推广,将会推动我国宪政的完善与发展。
Social contract theory has a long history in western country. It bases on freedom equality and human rights and affects the creation and development of western constitutionalism. Through the relationship of social contract theory and western constitutionalism combined with the analysis of present problems in China this paper concluded that the widespread of social contract theory will motivate the development and improvement of constitutionalism in China.
