摘要
                
                    在双一流高校建设背景下,高校教师流动频繁,违约离职现象普遍。但是由于高校与教师的法律关系不明确,教师法律地位不清晰,使得教师违约离职的法律适用不恰当,责任承担不合理,让高校的权益不断受到侵蚀。基于此,笔者通过《教育法》《劳动法》《高等教育法》《劳动合同法》等法律来明确界定高校与教师的法律关系,确定教师违约离职的法律适用及责任承担,从而在人才高速流动的大背景下,平衡高校和教师的权益,协调两者关系,促进高等教育事业的良性发展。
                
                Under the background of'double first-class'college construction,there is a greater job mobility among college teachers,bringing about a problem of how to apply laws properly as a result of breaching labor contracts.In view of the unclear legal relation between objects and subjects,the rights and interests of colleges and universities may be infringed when in the case of college teachers breaching the labor contract and quitting their jobs.The paper explores college teachers’liability for breach of labor contract with the application of such national laws as The Education Act,Labor Law,Higher Education Law,Labor Contract Law,etc.
